Waiver

I,                                                    , agree that while performing physical activity in this facility I am at risk of any and all injuries including death. I agree that I am performing such physical activities at my own willingness. Xcel Performance Inc. (and trainer) are not responsibly for any injuries or any loss of personal belongings.

This release of liability includes, without any limitation, all injuries which may occur as a result of usage of equipment (if sudden malfunction) or participation in any training session. I also acknowledge that accidents may occur while on the premise of the facility. Any accident occurring around the premise of the facility will not be held accountable by Xcel Performance Inc.

I have carefully read and understand the guidelines and policies put into action by Xcel Performance Inc. In the occurrence of any injury or accident I agree to discharge Xcel Performance Inc., and all affiliates, and individuals employed by Xcel Performance Inc. of any claim or causes of action. I waive any right that may otherwise bring any legal action against Xcel Performance Inc. regarding any injury or loss of personal belongings and damage to personal property.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, its agents, contractors and employees.

If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and the offending provision of provisions severed her from.

I have read and agree to the terms and services of Xcel Performance’s Policies and Consumer Protection Clauses.

By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.
